2026 Maryland General Assembly Makes Progress for Our Communities

Maryland’s General Assembly recently concluded the 2026 legislative session and made some important advances benefitting the people and communities Shore Legal Access serves. Below are some highlights of the 2026 General Assembly session.

 

 

Fair Chance in Housing Act (SB937)

 

 

This act ensures housing applicants are evaluated based on their current qualifications, rather than their past activity. Landlords are prohibited from requiring or requesting certain information related to criminal history during initial rental screenings.

 

 

Real Property – Access to Counsel in Evictions Program – Expansion (SB0729/HB1571)

 

 

For tenants living in mobile home parks, access to legal representation related to eviction challenges is now available through Maryland’s Access to Counsel in Evictions program.

 

 

Community Trust Act (SB791/HB1575)

 

 

This act ensures prevents local law enforcement agencies from detaining people based on immigration status without a judicial warrant or from taking any action without due notice.  

 

 

Transfer Upon Death Deed (HB738/SB651)

 

 

This is a significant win for a seamless transfer of generational wealth and personal property as it allows property owners to transfer real estate to beneficiaries upon death without going through the probate process.

 

 

Earned Wage Access (SB94)

 

 

This bill prohibits earned wage access providers (aka pay day loan companies) from collecting tips from consumers and requires compliance with the anti-discrimination provisions of Maryland’s lending laws.

 

 

Looking Ahead…

 

 

The Maryland Clean Slate Act passed the Senate, but did not pass the House. We are hopeful this groundbreaking bill that would help over 400,000 Marylanders secure better housing and employment will pass next year.
